District heating bylaws
The statutes of the city of Jena on the heat supply and connection to a central district heating supply for parts of the area of the city of Jena (district heating statutes) serve to protect the air and climate as the natural basis of life.
To reduce air pollutants, including climate-damaging carbon dioxide emissions from individual combustion plants, a district heating supply area was designated within the city of Jena.
The city council adopted the district heating bylaws of the city of Jena on 26.10.2016. The district heating bylaws were last amended on 27.11.2018. Further exemptions from the obligation to connect and use have been added.
Obligation to connect and use
The obligation to connect and use applies as soon as a property is located in a district heating supply area, a public district heating pipeline runs in the immediate vicinity, the property is developed with one or more buildings and heat consumption systems are to be operated on it.
The district heating statutes offer several options for exemption from the obligation to connect and use district heating. If certain criteria are met, an exemption from the obligation to connect and use can be granted on application. Further information in the FAQ section.

What exemptions from the connection and usage obligation are available?
Emission-free heating systems
For properties whose hot water or heating energy requirements, or both, are to be covered in part or in full by emission-free systems, an exemption from the obligation to connect and use is granted to the extent that the hot water and/or heating energy requirements are replaced by the aforementioned types of supply. Heating systems in which solid, liquid or gaseous fuels such as coal, coke, wood, crude oil, natural gas or propane are used are not considered emission-free.Emission-freeheating systems include, for example, solar thermal, geothermal or heat recovery systems.
Combined heat and power (CHP) + renewable energies
Properties with a heat requirement of at least 5 MW can be completely exempted from the obligation to connect and use heat if the entire heat requirement is covered by a combination of heat generation system(s) based on renewable energies and CHP system(s) operated with gaseous fuels. The heat quantity share of the heat generation system(s) based on renewable energies must cover at least 30 % of the total heat demand per year.
Combined heat and power generation
Properties with a heat requirement of at least 5 MW can be fully or partially exempted from the obligation to connect and use heat. The prerequisite for this is that the heat requirement can be covered in full or in part by CHP plant(s) operated with gaseous fuels. In addition, the CO2 emission factor of these CHP plant(s) may only correspond to a maximum of the CO2 emission factor of district heating generation in Jena. The applicant must prove compliance with this specified CO2 emission factor as part of the application for exemption from the obligation to connect and use.
Serious reasons
Exemption from the obligation to connect and use is granted as long as and to the extent that the connection of the property to the district heating supply system cannot reasonably be expected for serious reasons, particularly in consideration of the requirements of the public good. Exemption is granted if it can be credibly demonstrated by submitting appropriate documentation that the retrofitting of an existing system would jeopardize the economic existence of the property.
Are there properties that are generally exempt from the connection and usage obligation?
Properties with a single-family house (detached or semi-detached) or a detached two-family house as well as refugee accommodation in non-stationary structures (e.g. containers) are exempt from the connection and use obligation.
Can an emission-free heat generation system, such as solar thermal energy, be operated in addition to the district heating connection?
Yes, the installation and operation of emission-free heat generation systems in addition to a heat consumption system supplied with district heating is possible. In accordance with § 7 Para. 2, an exemption from the obligation to connect and use is granted on application to the extent that the hot water and/or heating energy requirement is replaced by the emission-free heat generation system.
Who has to apply for exemption from the obligation to connect and use?
The application for exemption must be submitted in writing by the property owner.
